Terms and Conditions

These Terms and Conditions govern the use of services provided by Rightprop Estate Agency to clients including landlords, tenants, buyers, and sellers. By engaging our services, you agree to be bound by the following terms.

1. Company Information

Rightprop is a UK-based estate agency offering property sales, lettings, valuations, and related  estate agency services. We are registered in England with company number 15507697  and operate in compliance with all applicable property and consumer legislation, including the Estate Agents Act 1979 and Consumer Protection from Unfair Trading Regulations 2008.

2. Our Services

We provide the following:

  • Residential sales and lettings
  • Property management
  • Tenant find and referencing
  • Market valuations
  • Mortgage and financial referrals
  • Legal and conveyancing support via third parties

Service-specific agreements (e.g., agency agreements or tenancy contracts) will apply in addition to these terms.

3. Client Responsibilities

Sellers & Landlords:

  • You must provide accurate and up-to-date information about your property.
  • You agree to supply all necessary legal documents, including Title Deeds, EPC certificates, and ID verification in compliance with AML regulations.
  • You are responsible for ensuring the property complies with safety standards (e.g., gas, electrical, fire regulations).
  • You agree not to instruct another agent during a sole agency period unless otherwise agreed in writing.

Buyers & Tenants:

  • You must provide accurate personal, financial, and employment details.
  • You agree to undergo referencing and Right to Rent checks as required by law.
  • Holding deposits are non-refundable if misleading or false information is provided during referencing.

4. Fees and Payment

All fees are disclosed in writing prior to service commencement. These include:

  • Sales commission (percentage of final sale price)
  • Letting fees (fixed or percentage-based)
  • Management fees (monthly percentage of rent)

Payment terms and cancellation policies are outlined in your signed agency or tenancy agreement.

5. Marketing & Advertising

We will market your property across our platforms and on major UK property portals. You grant us permission to use photos, descriptions, and floor plans for promotional purposes. You can withdraw your property from marketing with written notice, subject to any minimum contractual periods.

6. Compliance & Regulation

We are members of a government-approved redress scheme [e.g., The Property Ombudsman] and comply with:

  • Anti-Money Laundering Regulations
  • Client Money Protection rules
  • Data Protection Act and GDPR

We reserve the right to decline service if documentation or conduct breaches regulatory standards.

7. Cancellations & Terminations

You may cancel our services at any time by giving notice in accordance with your signed agreement. Early termination charges may apply where outlined in the agreement. We reserve the right to cancel our agreement if you breach these terms or fail to provide necessary documentation.

8. Liability

While we aim to provide accurate advice and professional service, we cannot be held liable for:

  • Losses incurred from missed deadlines, market changes, or third-party delays
  • Financial loss resulting from tenant or buyer conduct
  • Errors in information provided by third-party sources (e.g., mortgage brokers or solicitors)

9. Complaints Procedure

If you are dissatisfied with our service, please contact us in writing. We will acknowledge your complaint within 3 working days and aim to resolve it within 15 working days. If unresolved, you may escalate it to our redress scheme.

10. Data Protection

We handle all client data in compliance with the UK GDPR. Your data will only be used for the purpose of delivering our services and will not be shared without your consent unless required by law.

11. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the English courts.

12. Amendments

Rightprop reserves the right to update these terms. You will be notified of any material changes. Continued use of our services indicates acceptance of the revised terms.
